The purpose of this Privacy Policy is to inform you about the types of personal information Listli Inc. (herein referred to as, "Listli", "we", "our", or "us") collects, uses and discloses when you visit, interact with, or use our website and app featuring our Comparative Market Analysis Platform (the "Platform"). This Privacy Policy explains how we use and disclose that information, the choices you have regarding such use and disclosure and how you may correct that information.
Listli is proud to demonstrate our commitment to your privacy by complying with the laws and regulations under federal and provincial privacy laws applicable to British Columbia, including the Personal Information Protection and Electronic Documents Act (British Columbia).
We will treat personal information in a manner consistent with our Privacy Policy unless we have your consent to treat it differently.
Collection of Personal Information
To which companies does this Privacy Policy apply?
This Privacy Policy applies to the collection, use, and disclosure of personal information by Listli Inc.
What is personal information?
"Personal information" means any factual or subjective information about an identifiable individual. Personal information includes such information as a person's name, address, email address, phone number, date of birth and financial information. Specific Personal Information, such as your legal name, date of birth, phone number or email address, is obtained only if you supply it voluntarily.
What Personal Information do we collect?
When you visit or use our Platform, we do not automatically collect certain information about your device, including information about your IP address, web browser, time zone, time zone, and some of the cookies that are installed on your device. Additionally, we do not collect information about how you interact with the Platform, including, the individual pages that you view, any terms you might search, how many times you've visited our Platform, date and time stamps, transmitted data volume, operating system and other technical data such as details of your visits to our website. We refer to this automatically collected information as "Device Information." When we refer to Personal Information, we are also talking about Device Information, unless we address Device Information specifically.
We do, however, collect Personal Information that you may provide to us, including your basic personal details, such as your legal name, profile photo, job title, designations and qualifications, brokerage and business name, brokerage and business address, brokerage and team logos, website URL, title; contact data, such as your personal and business telephone number and email addresses; subscription and payment information, such as subscription and plan details, Stripe Customer ID and Stripe Subscription ID, Subscription expiry dates, and payment processing information; and demographic data, such as your address, geolocation data, preferences, interests, and other personal information relating to you that you may provide.
Furthermore, Listli may collect the following types of Personal Information upon obtaining your consent:
- information that we receive about you from other online entities who have initially obtained your information but have transferred it to us on a contractual basis so that we can provide our Platform to you;
- information, aggregate or user-specific, received from our Platform;
- other information you may provide when you contact our Customer Service Team or online chat;
- Device Information to screen and protect against fraud; and
- Real estate information such as property search criteria and filters, subject property information, comparative property data, generated Comparative Market Analysis reports, and property analysis and statistics.
Our Platform is intended for real estate professionals and is not directed to individuals under the age of 18. We do not knowingly collect personal information from children. If you, as a parent or guardian, believe your child has submitted or we have collected your child's Personal Information, please contact us immediately.
When and how do we obtain consent?
Before Listli collects, uses, or discloses your Personal Information, we first obtain your express or implied consent. The form of consent will largely depend on the sensitivity of the information and the reasonable expectation of privacy that you may have in specific circumstances. For example, we may obtain your express consent in writing, electronically, or verbally. Alternatively, your consent may be implied through an action that you've taken or by continuing to use our Platform after being notified of our policy or changes thereto. Since we obtain consent the first time we receive your Personal Information, by continuing to use our Platform, you imply that your consent is ongoing in accordance with this Privacy Policy.
How do we use technology to collect information through the Platform?
Cookies
A cookie is a small data file that is placed on your device and saved in your browser. Cookies do not damage computer systems or files, and only the website that transferred a particular cookie to you can read, modify, or delete such cookie. Cookies do not contain viruses.
A web browser is usually set to accept cookies automatically; however, this setting can be changed. If you don't want to use cookies with our Site, there is a simple procedure within your browser that will allow you to delete the existing cookies, automatically decline future cookies, or be given the option to accept or decline particular cookies in the future. On most web browsers, the "Help" section of the toolbar will tell you how to prevent your browser from accepting new cookies, how to have the web browser notify you when you receive a new cookie or how to disable cookies entirely.
The cookies we use on our App are called session cookies. Session cookies are automatically deleted at the end of your session. For example, if you are using our App, session cookies will remember you for the duration of your visit and any subsequent visit while the App is open. As soon as you close down the App, session cookies will be removed from your device. Please note that declining cookies on our Platform will significantly reduce or impair your user experience.
As further described below, we use Google Analytics, a third-party analytics service that uses cookies to track and analyze Personal Information, including website traffic, usage patterns, user behaviour, and to generate statistical reports about website activity. The Personal Information generated by the cookies will be transmitted to and stored by Google on their servers in the United States.
Google will use this information for the purposes of evaluating your use of our Site, developing reports on Site activity for us for the purposes of marketing and advertising, and internet usage. Where required to do so by law, Google may also transfer this information to third parties or to their service partners who process information on Google's behalf. Google will not associate your IP address with any other data held by Google. By using this website, you consent to the processing of data about you by Google in the manner and for the purposes set out above.
Google Analytics cookies are only loaded with your explicit consent through our cookie consent dialog. You can choose to accept or reject these cookies. If you reject cookies, Google Analytics will not be loaded, and no tracking cookies will be set on your device.
Declining the cookie consent dialog does not decline this Privacy Policy. However, if you do not agree to this Privacy Policy, then you must not access or use the Platform.
Note: We use localStorage (not cookies) to store your cookie consent preference and authentication tokens. This information is stored locally on your device and is not shared with third parties.
Use of Personal Information
How do we use your Personal Information?
The Personal Information you provide to us will be used to: confirm your identity, employment, education, and job title; set up accounts; provide on-going service related to the Platform; create your profile; generate and customize Comparative Market Analysis reports; determine your eligibility to subscribe to the Platform; adhere to legal and regulatory requirements set by the province of British Columbia, the federal government of Canada; verify your contact data such as your telephone number and email address; prevent errors and omissions; manage your subscription and process payments; screening account applications for fraud; send you information or communication; optimize and personalize your experience and brand settings on our Platform; to analyze usage patterns and improve our services; and to assess the success of our marketing and advertising campaigns.
When you send us an email or enter your Personal Information in an online form, we will collect your Personal Information in order to respond to you, to provide the requested services, or to improve our Platform. We will not pass on such data without your consent.
With your consent, we may also use your Personal Information to provide you with targeted advertisements, push notifications, or marketing communications that we believe may be of interest to you. You can withdraw this consent at any time from within the App or the settings on your device.
We do not sell, trade, or rent your Personal Information to third parties. We may share your information, only in the following circumstances:
- With your express or implied consent;
- To comply with legal obligations or court orders;
- To protect our rights, privacy, safety, or property;
- In connection with a business acquisition or merger; and
- With service providers who assist in operating our platform.
Where do we store your Personal Information?
We store your Personal Information in electronic form in Canada. Our service providers may, from time to time, also hold your Personal Information in connection with purposes for which you provided your consent. Our service providers may temporarily store your information internationally. By using the Platform, you consent to our service providers storing your Personal Information without geographical restrictions.
How long will we use, disclose, or retain your Personal Information and Device Information?
Your Personal Information will be used, disclosed, or retained for as long as necessary to fulfill the purposes for which it was collected and permitted or required by law. Generally, we do not disclose your Personal Information, and where we do, we will identify to whom and for what purposes the disclosure will be made and will obtain your consent to such disclosure.
We implement industry standard security arrangements to protect your Personal Information against risks such as unauthorized access, collection, use, disclosure or disposal. We integrate these security measures into the design, application, and operation of the Platform. We take commercially reasonable measures to evolve with the risks so that the integrity and confidentiality of your Personal Information and our systems are maintained.
For example:
- Passwords are encrypted using bcrypt hashing;
- Data is transmitted over secure HTTPS connections;
- User data is stored in MongoDB databases with access controls;
- Images are stored securely in AWS S3 with appropriate access permissions; and
- Regular security audits and updates are performed.
However, no method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your data, we cannot guarantee absolute security.
When you delete your account, we will delete or anonymize your Personal Information, except where retention is required or permitted by law.
Disclosure of Personal Information
We use third-party service providers to help us operate our Platform and to administer business activities on our behalf, such as sending emails, securing your account, generating comparative market analysis reports, obtaining real estate data, real time customer service, managing subscriptions and in-app purchases, and storing user images. We may share your Personal Information with these third parties for those limited purposes.
We use:
Google Analytics
Google Analytics, a web analytics service provided by Google LLC, to analyze website traffic and collect information about how users interact with the Platform. This information helps us analyze usage patterns, improve functionality, and optimize user experience. This service uses cookies to collect information about your use of our Platform. Google Analytics collects information such as IP address, device and browser information, pages visited, and interaction data. You authorize us to disclose your Personal Information to Google Analytics for these purposes, subject to Google's applicable privacy practices. You can opt out of Google Analytics tracking through our cookie consent dialog.
Stripe
Stripe for payment processing is used to process payments and manage financial transactions conducted through the Platform. When you subscribe to the Platform, your payment information is processed securely by Stripe at Stripe's data centers in Canada or the United States. We do not store your full payment card details. In connection with payment processing, we may disclose Personal Information such as name, billing address, payment method details, and transaction information to Stripe. You authorize us to share such information with Stripe to facilitate secure payment processing, fraud prevention, identity verification, and transaction confirmations related to your use of the Platform. Amazon Web Services S3 (AWS S3)
Amazon Web Services S3 ("AWS S3") provided by Amazon Web Services Inc., is used to securely store data and files associated with the Platform. Personal Information may be stored on AWS S3 in encrypted or protected form to ensure the availability, integrity, and security of the Platform. You authorize us to disclose and store Personal Information on AWS S3 for hosting, backup, and data management purposes.
OpenAI
OpenAI, an artificial intelligence service provider, to support certain AI-powered property estimation services on the Platform. This may include processing user inputs relating to property data, generating responses to improve functionality and the overall user experience, and generating and customizing the Comparative Market Analysis reports using MLS data. You authorize us to disclose Personal Information to OpenAI solely as necessary to provide these features, subject to applicable confidentiality, security, and data usage restrictions.
Bridge API (MLS Data)
Bridge API (MLS Data) to access and display real estate data on the Platform from the Multiple Listing Service ("MLS"). In connection with these services, limited Personal Information may be transmitted to or processed through the Bridge API to authenticate access, manage requests, deliver MLS-related functionality, and generate Comparative Market Analysis Reports. Your search criteria may be used to query MLS data through the Platform. You authorize us to disclose Personal Information as necessary to enable these services in compliance with applicable MLS rules and data use restrictions.
Nodemailer with Gmail
Nodemailer in conjunction with Gmail to send transactional and service-related emails, including account notifications, confirmations, and support messages. To facilitate these communications, we may disclose Personal Information such as your name, email address, and message content to Gmail. You authorize us to use this service to deliver communications related to your use of the Platform.
As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. Changes
We may update this Privacy Policy from time to time to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons. We will notify you before we make changes to this policy and give you the opportunity to review and comment on the revised policy before consenting to use our Platform.
We are also committed to keeping your Personal Information accurate. Please notify us of any changes to your information. By doing so, we can ensure our records are accurate, and we'll be better able to assist you. This includes changes to contact information, address, employment, occupation, and education.
State-Specific Information
If you are a California, Washington, or Nevada resident, you may request a notice disclosing the categories of Personal Information about you that we have shared with third parties for their direct marketing purposes during the preceding calendar year, if any.
Please submit your request to support@listli.ai and allow 30 days for a response. For your protection and the protection of all of our users, we may ask you to verify your identity before we disclose your Personal Information.
Jurisdiction
Your access to our Platform and this Privacy Policy are governed and interpreted by the laws of the Province of British Columbia. By using the Platform, you are consenting to the exclusive jurisdiction of the courts of the Province of British Columbia. You agree that such courts shall have in personam jurisdiction and venue and waive any objection based on inconvenient forum. You agree that you will not file or participate in a class action against us. In the event of any discrepancy between this English-language version and any translated copies of this Privacy Policy, the English version shall prevail.
